Terms of Use
1. Agreement to these terms
These Terms of Use apply to your use of moa-marketing.com (the "Site"), run by MOA Group Inc., a Massachusetts corporation ("MOA," "we," "us"). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
2. What the Site is for
The Site describes MOA's marketing and AI services and lets you contact us. Content on the Site, including articles, examples and statistics, is general information. It is not legal, financial, medical or other professional advice, and you should not rely on it as a substitute for advice about your own situation.
3. No client relationship from using the Site
Using the Site, submitting a form or booking a call does not make you a client of MOA. A client relationship begins only when you and MOA sign a written agreement. That agreement, not these terms, governs any services we provide, including pricing, deliverables, ownership and confidentiality.
4. Using the Site
You may use the Site for lawful purposes only. You agree not to:
- Use the Site in a way that breaks any law or infringes anyone's rights
- Try to gain access to any part of the Site, its systems or accounts that you are not authorized to use, including password-protected areas
- Interfere with the Site's security or operation, or introduce viruses, malware or other harmful code
- Scrape, copy or harvest content or data from the Site by automated means without our written permission
- Send spam, false information, or content that is abusive, defamatory or unlawful through our forms
5. Password-protected areas and tools
Some parts of the Site, including certain MOA tools, are available by invitation only. Access to those areas may be subject to additional terms we provide when access is granted. You must keep any login details private and not share them. We may suspend or end access to any part of the Site, including invitation-only tools, at any time.
6. Our content
The Site and everything on it, including text, design, graphics, logos and code, belong to MOA or the people who licensed them to us, and are protected by copyright, trademark and other laws. You may view and print pages for your own internal, informational use. You may not copy, republish, sell or create derivative works from the Site without our written permission. "MOA" and our logos are our trademarks. Other names and logos on the Site, including those of platforms we are certified with, belong to their owners and do not imply endorsement.
7. What you send us
When you send us information or ideas through the Site, you confirm that you have the right to share it. Personal information you send is handled under our Privacy Policy. Information you send before a written agreement is in place is not treated as confidential and creates no obligation for MOA, so please do not send confidential information through the Site.
8. Links to other websites
The Site may link to websites we do not control. We are not responsible for their content, policies or practices, and a link does not mean we endorse them.
9. Disclaimer
The Site is provided "as is" and "as available." To the fullest extent the law allows, MOA makes no warranties of any kind about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will always be available, error-free or secure, or that results described on the Site will be achieved in your case.
10. Limitation of liability
To the fullest extent the law allows, MOA and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business, arising from your use of, or inability to use, the Site. Our total liability for any claim relating to the Site will not exceed one hundred US dollars ($100). Some places do not allow these limits, so they may not fully apply to you.
11. Indemnity
You agree to defend, indemnify and hold harmless MOA and its owners, employees and contractors from claims, losses and costs, including reasonable attorneys' fees, that arise from your misuse of the Site or your violation of these terms.
12. Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law rules. Any dispute relating to the Site or these terms will be brought only in the state or federal courts located in Massachusetts, and you agree to their jurisdiction.
13. Changes to these terms
We may update these terms from time to time. We will post the updated version here and change the "Last updated" date. Continuing to use the Site after an update means you accept the new terms.
14. General
If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a right immediately, we have not given it up. These terms, our Privacy Policy and any additional terms for invitation-only areas are the whole agreement between you and MOA about your use of the Site.
